Ujęcie prawa cyengiwlo Zgodnie z art. 46. a7 1 Kodeksu cyengiwlo (k.c.), „nieruchomościami są części powierzchni ziemskiej stanowiące odrębny przedmiot własności (grunty), jak rf3wnież budynki trwale z gruntem związane lub części takich budynkf3w, jeżeli na mocy przepisf3w szczegf3lnych stanowią odrębny od gruntu przedmiot własności”[1]. Wyodrębnienie nieruchomości winno się odbyć pod względem prawnym (własnościowym) i fizycznym (w odniesieniu do gruntf3w – geodezyjnym). Ujęcie wieczysto-księgowe W myśl zapisf3w 24 ust. 1 ustawy o księgach wieczystych i hipotece, „nieruchomością jest część powierzchni ziemskiej, dla ktf3rej urządzono księgę wieczystą”[2]. Fakt utworzenia dla nieruchomości odrębnej księgi wieczystej jest wymogiem formalnym jej wyodrębnienia. „Księgi wieczyste prowadzi się w celu ustalenia stanu prawnego nieruchomości”[3]. Jednak, w ramach jednej księgi wieczystej mogą by ujawnione działki, ktf3re niekoniecznie muszą spełniać warunki określone w przytoczonym powyżej art. 46. a7 1 k.c.
